In a recent decision of 28 October 2020 (No. VIII ZR 230/19), the Federal Court of Justice (BGH) decided that the landlord is entitled to satisfy claims arising from the tenancy after termination of the tenancy from a cash deposit granted by offsetting, even if these claims are disputed. The ruling confirms the previous Senate case law.
